📋 Terms of Service
1 Who runs MemoCat
MemoCat is operated by Aleksei Okatev, a sole trader (Einzelunternehmer) registered in Germany. Our full postal address and contact details are in the Impressum.
2 Accepting these terms
By using MemoCat you agree to these Terms. If you do not agree, please do not use the service. You must be at least 16 years old, or have the consent of a parent or guardian.
3 Your account
- You are responsible for keeping your password safe and for what happens in your account.
- One person, one account. Making extra accounts to get around plan limits is not allowed.
- Tell us at support@memocat.org if someone else gets into it.
4 Acceptable use
Do not use MemoCat to store or share anything unlawful, to attack or overload the service, to scrape it in bulk, or to resell access to it.
5 What you write stays yours
Your decks, cards and notes remain your content. You give us only the permission needed to run the service: to store it, back it up, and show it back to you.
Publishing a deck to the marketplace is different — it makes that deck visible to everyone and copyable by other people. You can unpublish it at any time, but copies already made stay with the people who made them.
6 Pro, and who charges you
Pro is sold through the App Store. Apple takes the payment, not us.
7 Refunds
Because Apple takes the payment, Apple handles refunds. Ask for one at reportaproblem.apple.com.
We cannot issue a refund for an App Store purchase ourselves, however much we might like to.
8 Your right to withdraw
As a consumer in the EU you normally have 14 days to withdraw from a contract for digital services. Pro starts working the moment you buy it, so when you buy you agree that it begins immediately and acknowledge that the withdrawal right ends once it has.
For purchases made through the App Store, Apple's own terms and refund process apply.
9 The free plan
The free plan has limits on how many decks and cards you can keep. We may change those limits; if we reduce them, we will tell you first.
10 Ending it
You can delete your account at any time, from the app or the website. Everything goes with it.
We may suspend an account that breaks these Terms. If you think that was a mistake, write to support@memocat.org and we will look at it within 7 working days.
11 What we are liable for
We are fully liable for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
Otherwise we are liable only for breaking an obligation that is essential to this agreement — one you must be able to rely on for the service to work at all — and then only for the kind of damage that is foreseeable and typical for a service like this.
MemoCat helps you remember things. It is not a substitute for your own backups of anything you cannot afford to lose; you can export your decks at any time.
12 Changes to these terms
If we make a significant change, we will email you at least 30 days beforehand. Carrying on using MemoCat after that means you accept the change; if you would rather not, you can cancel and delete your account.
13 Law and disputes
German law applies. If you are a consumer, you keep whatever protections the law of your own country of residence gives you that cannot be set aside by agreement.
The European Commission runs an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we do not do so.
